General Terms and Conditions (GTC) of ANT Transport GmbH – Parking Service
(hereinafter referred to as the “Provider”)
§ 1 Scope of Application
These General Terms and Conditions apply to all contracts between the Provider and its customers regarding
- the paid provision of parking spaces in indoor areas (garage/hall) and outdoor areas,
- the shuttle service,
- as well as additional services, in particular vehicle cleaning and refueling services.
Any deviating general terms and conditions of the customer shall not apply unless their validity has been expressly agreed to in text form.
These GTC apply to both consumers and entrepreneurs. In the case of entrepreneurs, the provisions of commercial law shall additionally apply.
§ 2 Subject Matter of the Contract
The Provider shall provide the customer, for a fee and for the agreed period, with a parking space for a motor vehicle on premises operated by the Provider.
In addition, the customer may book a shuttle service between the parking facility and the agreed destination, in particular Munich Airport, provided that such service is included in the booking confirmation or service description.
No custody agreement (“Verwahrungsvertrag”) shall be concluded. The Provider does not owe safekeeping or special supervision of the vehicle, but solely the paid provision of parking facilities.
The Provider is under no obligation to guard, monitor, secure, or insure the vehicle or any items left inside the vehicle unless expressly agreed otherwise in writing or in text form.
§ 3 Booking and Conclusion of Contract
Bookings may be made verbally, by telephone, in writing, by e-mail, or online.
By making a booking, the customer submits a binding offer to conclude a contract.
The contract shall be concluded by
- the Provider’s express booking confirmation, or
- in the case of spontaneous use on site, by the actual use of the service, provided that the customer was informed of the applicability of these GTC in a reasonable manner prior to conclusion of the contract and had the opportunity to take note of their contents. The incorporation of GTC requires an appropriate notice at the time of contract conclusion and a reasonable opportunity for the customer to review them.
The Provider shall be entitled to reject booking requests without stating reasons.
§ 4 Prices and Terms of Payment
The prices displayed at the time of booking in accordance with the current price list, offer, or booking confirmation shall apply. Unless otherwise stated, all prices include statutory VAT.
Payment shall be made as agreed
- in advance, in particular by bank transfer or online payment, or
- on site, in particular in cash, by debit card, or by credit card.
Additional services, in particular parking extensions, shuttle surcharges, vehicle cleaning, or refueling services, shall be charged separately in accordance with the applicable price list.
For each additional extension day, the Provider may charge the applicable extension rate. Unless otherwise agreed, this currently amounts to EUR 29.00 including VAT per additional day.
§ 5 Use of Parking Spaces
The provisions of the German Road Traffic Regulations (StVO) and the instructions of the staff shall apply throughout the entire operating premises.
The customer shall be obliged to
- park the vehicle only in the assigned areas,
- secure the vehicle against rolling away,
- fully lock the vehicle,
- and hand over or park the vehicle in a roadworthy and operationally safe condition.
The storage or leaving behind of hazardous substances, in particular fuel canisters, gas cylinders, or other flammable materials, is prohibited.
Repair work, washing, refueling, or any other activities unrelated to parking are not permitted on the premises without the Provider’s consent.
The customer must ensure that no operating fluids leak uncontrollably. Any cleaning or removal costs caused by a vehicle brought onto the premises by the customer shall be borne by the customer insofar as the customer is responsible for such contamination.
§ 6 Indoor and Outdoor Parking Spaces
Indoor parking spaces (garage/hall) provide protection from weather conditions and are available only in limited numbers.
Outdoor parking spaces are located on open premises without roofing.
The customer shall only be entitled to a specific parking space if this has been expressly agreed.
The Provider does not owe any specific security equipment or level of security, in particular no video surveillance, fencing, barrier systems, or guarding services, unless expressly agreed otherwise.
§ 7 Vehicle Key Arrangements
As a rule, the vehicle key shall remain with the customer unless expressly agreed otherwise.
Where handing over the vehicle key is required in individual cases, in particular for maneuvering purposes, vehicle cleaning, or refueling services, this shall be agreed separately with the customer.
In such cases, the Provider shall be entitled to move or reposition the vehicle on the operating premises to the extent necessary for the agreed service purpose or for orderly business operations.
§ 8 Shuttle Service
The shuttle service includes the transportation of the customer and accompanying passengers between the parking facility and the agreed destination and back.
Unless otherwise agreed, the shuttle service operates 24 hours a day, 7 days a week. Journeys are generally carried out at hourly intervals.
Transfer times are generally approximately 20 minutes but may be extended due to traffic conditions, weather, official measures, or other circumstances beyond the Provider’s control.
Transfers shall generally be made directly to the terminal; pick-up after return shall likewise take place directly at the terminal. The meeting points and instructions communicated by the Provider shall be decisive.
The Provider shall be entitled to provide shared transfers where this is reasonable for the customer. Minor waiting times may occur due to operational reasons and shall be deemed reasonable.
The customer is obliged to arrive at the parking facility or agreed meeting point in due time. For departures, it is recommended that customers arrive at the parking facility at least 2.5 hours before departure.
Unless otherwise agreed, the parking fee includes transfers for up to 4 persons.
From the 5th person onward, a surcharge currently amounting to EUR 5.00 per person may be charged.
The maximum number of passengers per shuttle or booking is 8 persons.
For journeys between 10:00 p.m. and 6:00 a.m., a night surcharge currently amounting to EUR 15.00 may be charged.
The Provider shall only be liable for delays or service restrictions caused by traffic jams, weather conditions, heavy traffic, official orders, flight schedule changes, force majeure, or other circumstances beyond the Provider’s control in accordance with § 11. No strict liability shall be assumed for missed flights or missed connections.
§ 9 Additional Services: Vehicle Cleaning
The customer may book additional cleaning services for a separate fee, in particular interior cleaning, exterior cleaning, or full-service cleaning.
The exact scope of services shall be determined by the current service description or price list.
For the performance of cleaning services, the Provider shall be entitled to move the vehicle on the operating premises or into a suitable garage/hall.
The customer shall inform the Provider of any particular sensitivities of the vehicle, pre-existing damage, special wraps/foils, or retrofitted attachments before the cleaning services commence.
The Provider’s liability for damage in connection with cleaning services shall be governed by § 11.
§ 10 Additional Service: Refueling Service
Where a refueling service has been booked, the Provider shall refuel the vehicle in accordance with the specifications communicated by the customer.
The customer is obliged to specify the correct type of fuel.
Billing shall be based on the actual refueling amount according to receipt plus the agreed service fee.
The Provider’s liability for damage in connection with the refueling service shall be governed by § 11.
§ 11 Liability
The Provider shall be liable without limitation
- in cases of intent and gross negligence,
- for culpable injury to life, body, or health,
- and in cases of mandatory statutory liability.
In cases of ordinary negligence, the Provider shall only be liable for the breach of an essential contractual obligation (“wesentliche Vertragspflicht”). In such cases, liability shall be limited to the typical foreseeable damage arising under the contract. Such clauses are subject to the legal review of standard business terms; in particular, liability for intent, gross negligence, and personal injury may not be excluded in GTC.
To the extent permitted by law and subject to paragraphs 1 and 2, the Provider shall not be liable for damage caused by third parties, vandalism, theft, burglary, storms, hail, flooding, other natural events, or other external circumstances, unless the Provider is at fault.
The Provider shall only be liable for valuables, cash, documents, electronic devices, or other items left in the vehicle in accordance with the above provisions.
Obvious damage to the vehicle or complaints should be reported by the customer as soon as possible upon collection. Claims asserted later must be proven by the customer. The Provider may refuse settlement if, due to delayed notification, reliable attribution to the Provider’s sphere of responsibility is no longer possible.
§ 12 Cancellation, Rebooking, Failure to Appear
The customer may cancel the booking as follows:
- up to 24 hours before the agreed parking start time: free of charge,
- less than 24 hours before the agreed parking start time: 50% of the agreed total price,
- failure to appear without cancellation (“no-show”): 100% of the agreed total price.
The relevant time shall be the time at which the cancellation is received by the Provider.
The customer shall retain the right to prove that the Provider suffered no damage or substantially lower damage. Such opening clauses are important for lump-sum compensation clauses in GTC to avoid unreasonable disadvantage to the customer.
Rebookings are possible subject to availability. Any additional or reduced charges shall be adjusted accordingly.
§ 13 Parking Duration and Overstay
The agreed parking duration shall result from the booking confirmation or the agreement made on site.
If the booked parking duration is exceeded, the Provider shall be entitled to charge additionally incurred parking time in accordance with the applicable price list.
If the customer leaves the premises without full payment, any further statutory claims of the Provider shall remain unaffected.
§ 14 Data Protection
The Provider processes the customer’s personal data exclusively in accordance with the applicable data protection regulations, in particular the GDPR and the German Federal Data Protection Act (BDSG).
Further details are set out in the Provider’s separate privacy policy.
§ 15 Right of Withdrawal for Consumer Contracts
If the customer is a consumer and the contract is concluded under the conditions of an off-premises contract or a distance contract, statutory rights of withdrawal may apply. Section 312g of the German Civil Code (BGB) governs the right of withdrawal for distance and off-premises contracts as well as statutory exceptions.
Whether a right of withdrawal exists or is excluded in individual cases shall be determined in accordance with statutory provisions and the Provider’s separate withdrawal policy.
Where legally required, the Provider shall provide the customer with a separate withdrawal notice prior to conclusion of the contract.
§ 16 Applicable Law and Place of Jurisdiction
The law of the Federal Republic of Germany shall apply, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
If the customer is a merchant, a legal entity under public law, or a special fund under public law, the place of jurisdiction shall be the Provider’s registered office, to the extent legally permissible.
For consumers, the statutory provisions regarding jurisdiction shall apply.
§ 17 Final Provisions
Should any provision of these GTC be or become wholly or partially invalid, the validity of the remaining provisions shall remain unaffected. Pursuant to Section 306 BGB, the contract shall otherwise remain effective even in the event of invalid GTC clauses.
The statutory provisions shall apply in place of the invalid provision.
